Terms of Use

These Terms of Use ("Terms") govern your use of KEN3 ("KEN," "we," "us," or "our"), a product of Ofilix Technology Limited.

By creating an account or using KEN, you agree to these Terms.

KEN is an AI-powered local intelligence and mobility platform. KEN provides information, recommendations and tools relating to places, businesses, locations, community knowledge and mobility.

KEN is currently a prototype / early-stage product. Features, coverage, and the accuracy and behavior of KEN's AI may change substantially, without notice, as the product develops.

You must be legally permitted to use KEN in your jurisdiction.

If you are under the applicable age for providing consent to online services, use KEN only with the involvement or permission of a parent or guardian where required by law.

You are responsible for:

• Providing accurate information
• Keeping your login credentials secure
• Activity conducted through your account
• Informing KEN if you believe your account has been compromised

KEN may provide answers using approved community knowledge, business information, maps, third-party information and AI-generated responses, generated using large language models, Google Maps Platform data, and voice AI including ElevenLabs.

KEN's AI is under active development and is continuously learning. KEN does not guarantee that every answer is accurate, complete, current or suitable for your particular circumstances. AI-generated information should be independently verified where accuracy is important.

KEN is designed to assist users with information and navigation.

KEN does not guarantee personal safety, road conditions, business conditions, accessibility, availability or the accuracy of information.

Users remain responsible for their own decisions and safety.

Do not use KEN while driving in a manner that distracts you or violates applicable law.

KEN may provide location-sharing functionality such as My Pin.

Users control when they share their location.

You are responsible for choosing who receives your shared location.

Do not share another person's location without appropriate permission.

Users may contribute reviews, local knowledge, accessibility information, tips and other information.

You agree that contributions:

• Are truthful to the best of your knowledge
• Do not intentionally mislead others
• Do not violate another person's rights
• Do not contain unlawful or harmful content
• Do not impersonate another person
• Do not contain malicious code or spam

KEN may review, moderate, edit, reject or remove contributions. Only approved contributions may be treated as approved KEN Knowledge.

Businesses may create business profiles and offers according to their subscription plan.

New business listings are subject to review and approval by KEN before appearing live to users.

Businesses are responsible for the accuracy and legality of information they submit.

KEN may remove inaccurate, misleading or prohibited business information.

Businesses are responsible for honouring offers they publish.

KEN does not guarantee that a business will honour an offer unless expressly stated otherwise.

Paid KEN plans are subject to the pricing, billing cycle and payment terms displayed at checkout.

Payments may be processed through Paystack or another payment provider.

Subscription terms, renewal and cancellation information will be presented during the relevant purchase flow.

You must not:

• Use KEN for unlawful purposes
• Abuse or attempt to disrupt the service
• Attempt to access another user's account
• Submit fraudulent information
• Upload malicious software
• Scrape or systematically extract data without permission
• Manipulate reviews or contributor information
• Misuse location-sharing functionality
• Impersonate users, businesses or KEN
• Circumvent security or access controls

KEN's software, branding, logos, designs and original content belong to Ofilix Technology Limited or its licensors unless otherwise stated.

You retain rights in content you submit, but you grant KEN the permissions necessary to host, display, moderate and use that content to operate and improve KEN, subject to the Privacy Policy and applicable law.

KEN relies on third-party services, including but not limited to:

• Google Maps Platform — mapping, directions and location data
• ElevenLabs — voice AI and speech synthesis
• Paystack — payment processing
• Other AI model providers, hosting providers, and infrastructure integrations, which may change as KEN's technology stack develops

Third-party services have their own separate terms and policies, which may also apply to your use of KEN.

KEN is provided on an ongoing basis but may occasionally be unavailable due to maintenance, technical problems, or circumstances outside our control.

As an early-stage / prototype product, KEN's features, geographic coverage, AI behavior, and business listings are expected to change, expand, or be temporarily withdrawn as the product develops.

To the extent permitted by applicable law, KEN and Ofilix Technology Limited are not responsible for losses arising from reliance on inaccurate third-party information, business information, community contributions, AI-generated responses, directions or other information provided through the service.

Nothing in these Terms excludes liability that cannot legally be excluded under applicable Nigerian law.

KEN may suspend or terminate accounts that violate these Terms or misuse the service.

Users may stop using KEN at any time.

We may update these Terms as KEN develops. Continued use of KEN after changes take effect constitutes acceptance where permitted by law.

These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes arising under these Terms are subject to the exclusive jurisdiction of the courts of Lagos State, Nigeria.
